In the landmark 2006 Burlington Northern case, the U.S. Supreme Court greatly expanded the definition and scope of retaliation claims. In the past year the High Court has upped the ante, giving employees new avenues to bring these claims.
And plaintiffs’ lawyers are taking advantage. As an HR executive, you might do everything right: draft a solid policy, conduct a prompt, thorough investigation of harassment complaints, deliver training – and still get blindsided by a retaliation claim. Or a supervisor who doesn’t know the law might take an adverse action against an employee who made a complaint or engaged in some other “protected activity.” That’ll trigger a retaliation lawsuit every time.
