COURSE DESCRIPTION: On January 1, 2009, the Americans with Disabilities Act Amendments Act of 2008 goes into effect and companies must comply. Warning: It’s not going to be easy.

If you think you know the definitions of key ADA terms such as "disability," “substantially limits” and “major life activities,” think again. They’ve all been expanded by this law, and in the next year lots of companies are no doubt going to get sued because they failed to educate their supervisors and change their policies. Don’t be one of them.

In this course, our speaker will cover the key ADA changes and suggest ways you can protect yourself from a law that some fear will allow things like seasonal allergies and muscle strains to qualify as disabilities. He’ll explain how the ADAA rejects several Supreme Court decisions over the past decade and how portions of EEOC's ADA regulation have been revised.

Participants will learn the working definitions of key ADA terms such as:

  1. disability
  2. reasonable accommodation
  3. undue hardship

At the end of the conference, participants will understand:

  • The new list of “major life activities”
  • The new term “materially restricts” (which intends to clarify “substantially limits”)
  • Who’s protected and who isn’t?
  • What types of illnesses will likely qualify as disabilities
  • What a supervisor can ask in an interview?
  • How to make sure your employment applications and job descriptions are safe
  • How managers should respond to day-to-day ADA situations
  • How “perception” trumps “reality” with the ADA
  • Three critical management mistakes to avoid.
