COURSE DESCRIPTION: The Department of Labor just published the new FMLA regulations, and they contain an avalanche of new provisions that companies need to know. Companies will need to make changes, and they’ll also have new options for handling leave after January 16, 2009.

Our speaker, attorney Linda Hollinshead of WolfBlock LLP., has poured over the 762-page package of FMLA regs and accompanying preamble and prepared a focused two-hour program that will:

  • Clarify the key changes in the final rule
  • Explain key differences between the final regs and the proposed regs
  • Suggest revisions to your FMLA policy and forms to be used to obtain medical certifications
  • Offer advice on training managers and supervisors to handle the changes
  • Provide other action steps to comply with the new rules and take advantage of the many employer benefits included in the new law.

Key topics covered:

  • FMLA Notice: The regs include new guidance on employee requirements for requesting foreseeable and unforeseeable leave
  • Medical certification: Changes include:
    • An extended window for employers to request medical certification after receiving FMLA notice
    • New rules regarding employers’ ability to contact doctors regarding certifications, including restrictions on supervisors
    • New recertification and fitness-for-duty provisions
    • New medical certification forms
  • Intermittent leave: The new regs include more employer-friendly language to prevent abuse
  • “Serious health condition”: Changes in the definitions of several categories of a serious health condition will be explained
  • FMLA leave for Military-related events: The new “qualifying exigency” terminology and service member caregiver leave will be explained
  • FMLA and attendance bonuses: Under the new regulations, absences under the FMLA may now be taken into account when awarding attendance bonuses
  • And much more …
